VentCert by Assentech
Terms and conditions
These terms apply to every VentCert course, exam and certificate. By ordering places, redeeming a code or using the VentCert website you agree to them.
1. Who we are
VentCert is provided by Assentech Sales Ltd, a company registered in England and Wales (company number 06746170), of Glen View, Trispen, Truro, TR4 9AU ("Assentech", "we", "us").
You can contact us about VentCert at daniel.pearce@assentech.co.uk.
VentCert is an Assentech certification. It is not issued, endorsed or accredited by API, ISO, the Environment Agency, any equipment manufacturer or any other third party. Names of standards, regulators and manufacturers are used only to describe course content and belong to their owners.
2. Words we use
- Customer: the company or person who orders places or resits and pays our invoice.
- Attendee: the person who uses a code to take a course and sit its exam.
- Place: access to one course and one exam attempt for one attendee.
- Resit: one further exam attempt for an attendee already on that course.
- Code: the attendee code we issue for each place or resit.
3. Ordering and paying
- Customers request places or resits through the course page or by sending us a purchase order.
- A contract is formed when we confirm the order and issue the codes.
- Prices are shown on each course page and are per person, excluding VAT. At the date of these terms a place costs £249 and a resit costs £95, plus VAT. The price that applies is the one shown when we confirm the order.
- We invoice the Customer when we issue the codes. Invoices are payable within 30 days of the invoice date unless we agree otherwise in writing.
- If an invoice is not paid on time we may suspend the codes on that order, and any exam attempts and certificates that depend on them, until it is paid.
4. Attendee codes
- Each code can be used once, by one attendee.
- A code must be redeemed within 12 months of the date we issue it. Unredeemed codes then expire.
- Before a code is redeemed, the Customer may give it to a different attendee. Once redeemed, it belongs to that attendee and cannot be transferred.
- A resit code only works for an attendee already on the same course. It must be redeemed with the same email address the attendee used for the course.
- Keep codes safe. We are not responsible for a code used by someone the Customer did not intend, but we will cancel and reissue an unredeemed code on request.
5. Using the course
- Access is personal to the attendee. Sign-in details must not be shared, and one attendee's account must not be used by anyone else.
- Attendees will have access to the course content for at least 12 months from the date their code is redeemed.
- All course content, questions, images and videos belong to Assentech or are used with permission. Attendees may use them for their own training only. They must not be copied, recorded, downloaded, shared or published.
- We may update course content to keep it accurate and in line with current standards.
6. The exam
- Each place includes one exam attempt. Starting the exam uses that attempt, whether or not the attendee finishes it.
- The exam is timed. The clock starts when the attendee starts the exam and does not stop. If the attendee's connection drops or the page is closed, they can return to the same attempt with their saved answers until the time runs out, but no extra time is given. When time runs out, the saved answers are marked.
- Questions are drawn at random from a confidential question bank. Attendees must not copy, photograph, record or share any question or answer.
- Attendees must sit the exam alone and without help from anyone else. Each time the attendee leaves the exam page (for example by switching tab or window) it is recorded and reported to Assentech and the Customer alongside the result.
- Exams are marked automatically. The pass mark is shown on the course page. Results are final, except where section 9 applies.
- An attendee who fails may sit the exam again only with a resit, which must be ordered and paid for.
- If we have reasonable grounds to believe an attendee has cheated, for example by having someone else sit the exam, working with others or sharing questions, we may cancel the result and any certificate without refund.
7. Certificates
- An attendee who passes is issued a VentCert certificate with a unique number. Certificates are valid for 3 years from the date of issue.
- Anyone can check a certificate on the public register by entering its number. The register shows the attendee's name, company, course, issue and expiry dates, and whether the certificate is valid, expired or revoked.
- We may revoke a certificate if it was issued in error, if section 6.7 applies, or if the invoice for the place remains unpaid.
- A certificate confirms that the attendee passed the VentCert assessment for that course. It does not authorise anyone to carry out work on any site, and it does not replace site-specific competence checks, permits to work, risk assessments or manufacturer training.
8. Cancellations and refunds
- VentCert is sold to businesses. A Customer may cancel an order in full within 14 days of our invoice, provided none of its codes has been redeemed, and we will cancel the invoice or refund it in full.
- Codes that have been redeemed, including resit codes, are not refundable.
- After 14 days, unredeemed codes are not refundable, but the Customer may give them to a different attendee until they expire.
- If the Customer is an individual buying for themselves rather than for a business, they have a legal right to cancel within 14 days. By redeeming a code and starting the course within that period they agree that the service has begun, and their refund will reflect the course used.
9. Technical problems
- If an exam attempt is lost or cannot be completed because of a fault on our side, we will restore the attempt or provide a free resit.
- Problems with an attendee's own device, browser or connection do not stop the exam clock and do not entitle the attendee to a free resit.
- We aim to keep VentCert available at all times but do not guarantee it will be uninterrupted. We may take it offline for maintenance.
10. Our responsibility to you
- Our courses are training material based on published standards and Assentech's experience. They do not replace the standards themselves, manufacturers' instructions or the Customer's own procedures and risk assessments.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
- Otherwise, we are not liable for any indirect or consequential loss, or for loss of profit, business or data, and our total liability under any order is limited to the amount the Customer paid for that order.
11. Personal information
We handle attendees' and Customers' personal information as described in our privacy notice.
12. Changes and law
- We may update these terms. The version shown when we confirm an order applies to that order.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
